What kind of impact could this ordinance have?

Brett Ellis/Fremont Tribune | Posted: Thursday, June 17, 2010 11:05 am

If Fremont voters approve the immigration ordinance on Monday, it could potentially change the way landlords and businesses operate.

What remains unclear, though, is exactly how those changes would be enforced.

The ordinance would require all employers within city limits to use the federal E-Verify system when hiring new employees. Businesses such as Hormel Foods Inc. and Fremont Beef are not located inside city limits and would not be affected by the ordinance. Both already use E-Verify.

Businesses that apply for any business license or permit in Fremont, or that are awarded a contract to work for the city, would be required to submit an affidavit that the business does not knowingly employ any person who is an unauthorized alien and also must provide documentation showing that the business participates in the E-Verify program.

Businesses that violate the ordinance would be tried at a public hearing by the city council, could be subject to civil action by the city attorney and trade-specific permits could be revoked.

Many local businesses, including Fremont Area Medical Center, already use the E-Verify system.

"FAMC has always maintained policies prohibiting the known hiring of any undocumented person, and has utilized the I-9 system since its inception and the federal E-Verify program since early 2009," FAMC Director of Human Resources Andy Kresha said in a statement. "FAMC intends to continue to utilize these programs, regardless of the outcome of the ordinance vote.

"E-Verify is certainly not a perfect system, but the best currently available."

Cry of racism rings hollow

—  In response to the article that racial profiling is wrong I have sat in silence for long enough.

When the majority of illegal immigrants — not "undocumented" as the politically correct would like to say — cross our borders, they reap resources off the back of the working class American and then take the jobs of the working American.

They even dare protest and file lawsuits against us for trying to stop this flood of illegal activity.

The federal and even our local governments stand up for the so-called rights of the illegals that are invading our country, taking our jobs, getting free education, food stamps, welfare, and committing crime.

Our schools are broke, hospital emergency rooms are suffering, our health insurance has skyrocketed, auto insurance is out of sight and we are called a racist nation because the American people are sick and tired of footing the bill.

We have no more money, folks. We have no more jobs. Working Americans are losing their homes while the illegal is getting free or almost free housing. But we who complain are considered racist.

I didn’t use to be a racist; I don’t like to think of myself as one now. I am part Cherokee Indian part Scottish and married to a woman who is half Mexican. But because I complain I am a racist?

If the majority of those crossing the borders are Hispanic, wouldn’t it be a natural instinct for an officer pulling over a vehicle full of people who don’t speak English to ask of identification? Does that make them a racist?

Sorry but the "R" word just isn’t working anymore.

Arizona’s SB1070 Legislation Mischaracterized

Arizona recently passed SB1070. A lot of disinformation has been spread about this legislation. Arizona was forced into taking these measures because of the lack of the federal government to enforce the law and secure the border.

The new law mirrors federal law which requires aliens to register and carry their documentation with them. Arizona’s new law now states that violating federal immigration law is now a state crime as well.

The law was designed to avoid the legal pitfall of pre-emption, which means a state law can’t adopt a law that conflicts with federal law. The law allows police to ask about immigration status in the normal course of lawful contact, such as a traffic stop or crime investigation. Before asking a person about their immigration status, the police must have a reasonable suspicion that the person is illegal. Since Arizona does not issue drivers licenses to illegal aliens, having a valid driver’s license creates a presumption of being here legally. On the other hand, if someone is stopped for buying fraudulent identity documents, has no license or other form of federal identification or is recognized as someone who has previously been deported, those are grounds to ask about immigration status.

The law specifically states that police may not solely consider race, color or national origin when implementing SB1070. Actually, I don’t think the law went far enough. They left out an important piece in the illegal alien puzzle. There should be sanctions and penalties against employers who hire the illegals as well.

To hear the news reports and the rhetoric from the White House, you’d think this draconian legislation would have jackbooted troopers kicking in doors to round up the illegals. Just remember, you can’t believe everything you hear, especially from our community organizer in chief.
